2 EXPECTED RESULTS

While we believe that for most people, using our products and following our programmes and methods will lead to their desired results, all products and exercise programs depend on the individual. Results will be affected by the effort and commitment of the individual, however in some circumstances even where an individual follows our program and advice, they may not achieve the desired results. We therefore provide no warranties of any kind.

3 ONLINE STORE TERMS 

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

None of the meal plans or exercise program's should be performed or otherwise used without clearance from your physician or health care provider first. The information contained within is not intended to provide specific physical or mental health advice, or any other advice whatsoever, for any individual or company and should not be relied upon in that regard. We are not medical professionals and nothing on this website should be misconstrued to mean otherwise.

There may be risks associated with participating in activities mentioned on our site for people in poor health or with pre-existing physical or mental health conditions. Because these risks exist, you will not participate in any meal plan's available from us. If you are in poor health or have a pre-existing mental or physical condition and still choose to participate in these, you do so of your own free will and accord, knowingly and voluntarily assuming all risks associated with such activities. These risks may also exist for those who are currently in good health right now.

As with any exercise program you assume certain risks to your health and safety. Any form of exercise program can cause injuries, and our programs are no exception. It is possible that you may become injured doing the exercises in your program, especially if they are done with poor form. Be aware that our programs (like any other exercise program) do involve a risk of injury. If you choose to participate in these risks, you do so of your own free will and accord, knowingly and voluntarily assuming all risks associated with such exercise activities. These risks may also exist for those who are currently in good health right now.

We are not a medical practitioners. Our advice whether it be on our website, in our meal plan's, exercise program's or via email coaching, none of it is meant as a substitute for medical advice. You must consult your doctor before beginning ANY meal plan or exercise program, no exceptions. You are using our plans, program's, workout's and coaching at your own risk and we are not responsible for any injuries or health problems you may experience or even death as a result of using our programs.

It is to be made clear that we are not responsible for any injuries or health problems you may experience or even death as a result of using any of our products or services.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

15 DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY 

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

17 TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

18 ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

19 RETURNS AND REFUNDS POLICY

No returns or refunds on digital products and services (including personal training fees).

IF YOU HAVEN’T DOWNLOADED THE PROGRAMMES/PLANS WITHIN THE 24 HOURS AFTER RECEIVING DOWNLOAD LINK (EMAIL), YOU CANNOT ASK FOR A REFUND.

For physical products, you have 14 days from the date you receive all items to return to Ajmalkhurram.com. You have to present the purchase receipt, full name, quantity of the product you are returning along with the items you wish to return.

For personal training sessions there is a 24h cancellation/ rescheduling policy. If the 24 hour notice period is not satisfied the session may not be rescheduled and will be counted unless mitigating circumstances are met e.g. illness. If client is late to the session, the time will be subtracted from the session and the session will end at the scheduled time unless discussed otherwise. Payments are to be made in advance of the sessions. All packages have a 4 week deadline, meaning all sessions must be completed within the 4 week time frame or subject to a minimum of 3 sessions per week will be accounted for. Exceptions will be made if mitigating circumstances are met eg illness or holiday. The packages are non refundable.

The customer is responsible to pay for returned items to Ajmal Khurram (we would recommend using a trackable shipping service or purchasing shipping insurance, we don’t guarantee that we will receive your returned item and we are unable to process a refund or exchange if we have not received the item back).

Upon receipt and inspection of all items a refund will be made subject to the items being in the same unused condition (seal not broken, original packaging): We will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your original method of payment.

Shipping costs are non refundable.

20 PRIVACY POLICY
